Terms of Use and Privacy Policy

1. Introduction

Welcome to Imagination Generation, a program operated by Inspirography LLC. These Terms of Use and Privacy Policy (collectively, the “Agreement”) govern your access to and participation in our website, camp sessions, Minecraft server, Discord communications, Google Meet calls, and any related services (collectively, the “Services”).

By registering your child for participation in our programs, or by accessing the Website, you (“Parent” or “Guardian”) agree to these Terms and acknowledge our Privacy practices. This Agreement applies both to parents/legal guardians and their enrolled children (“Students”).

Participation in our programs requires parental consent, acknowledgment, and agreement to these Terms. Parents are the holders of the Website account and must be the responsible contracting party for all transactions.

2. Accounts and Access

• Student Accounts on Third-Party Platforms:
  
  

  • Students access programming through third-party platforms, including but not limited to Minecraft (Microsoft account), Discord, and Google Meet (Google account).
    
    

  • These accounts are held and governed by the respective third-party providers. Inspirography LLC does not create, control, or manage those accounts.
    
    

  • Students’ access to these platforms is separate from Website access.
    
    
    

• Content Uploads and Submissions:
  
  

  • Parents may upload certain information or content to the Website.
    
    

  • Students cannot directly upload content to the Website.
    
    

  • Students may, however, submit screenshots of their Minecraft builds to staff, which staff may incorporate into reports, showcases, or limited marketing materials.
    
    

  • Teachers may submit testimonials and reviews that may be displayed publicly.
    
    
    

3. Payments and Refunds

• Payments are processed securely via Stripe.
  
  

• Payment options include one-time payments per camp session or payment plans (weekly or bi-weekly) to accommodate payroll schedules.
  
  

• Parents authorize Inspirography LLC to charge their selected payment method according to their chosen plan.
  
  

• Refunds, if offered, will be subject to Inspirography LLC’s sole discretion and stated refund policy at the time of registration.
  
  
  

4. Program Structure and Schedule

• Sessions are generally 2–3 hours in duration, with access limited to prescribed times.
  
  

• A makeup session will be offered on Sunday between Week Three and Week Four of the camp session, outside of normal scheduled times.
  
  

• Staff will monitor and escalate to parents if a Student exhibits signs of distress, unusual behavior, or concerning engagement during sessions.
  
  
  

5. Waivers and Disclaimers

Parents expressly acknowledge and accept the following:

• Screen Time Risks: Excessive computer use may lead to ergonomic strain, eye strain, and fatigue. Parents agree to supervise their child’s use and ensure healthy practices.
  
  

• Academic Risks: Participation may take time away from schoolwork. Parents agree they are responsible for balancing academic priorities.
  
  

• Third-Party Risks: Discord, Minecraft servers (outside of Inspirography LLC’s control), and other online environments may expose children to content, interactions, or risks outside of our authority. We disclaim liability for external activity.
  
  

• General Online Risks: Risks inherent to online communication, including exposure to inappropriate material, miscommunication, or technical disruptions, are expressly waived by the Parent.
  
  

By enrolling, Parents release Inspirography LLC from liability for these risks and acknowledge their supervisory role.

6. Content Rights

• Inspirography LLC does not claim ownership of Minecraft builds, creative works, or other Student-generated content.
  
  

• Parents and Students grant Inspirography LLC a limited, non-exclusive, worldwide license to use submitted screenshots, session replays, recordings, and other Student content strictly for camp purposes and promotional/marketing materials.
  
  

• Parents may opt out entirely from the use of their child’s likeness, voice, opinion, authentic perspective, and any identifying attributes.
  
  

• Opt-out requests must be submitted in writing and will be honored in all future marketing, though past published materials may remain in circulation.
  
  

7. Data Collection, Storage, and Privacy

• What We Collect:
  
  

  • Session recordings (video, audio, voice, chat logs, and Minecraft world replays).
    
    

  • Submitted screenshots of builds.
    
    

  • Teacher-generated testimonials and reports.
    
    

• What We Do Not Collect:
  
  

  • We do not collect analytics on time spent or chat logs for analytics purposes.
    
    

• Retention:
  
  

  • Recordings and related data are retained for up to nine (9) years, unless a Parent requests earlier deletion.
    
    

• Use:
  
  

  • Recordings may be used to create YouTube videos and other promotional content, subject to opt-out rights described above.
    
    

• Deletion Requests:
  
  

  • Parents may request deletion of accounts or personal data at any time via administrator request.
    
    

  • Deletion requests may limit or terminate the Student’s ability to participate in future sessions.
    
    
    

8. Communications

• Parents consent to receive service-related communications, including reminders, updates, scheduling information, and safety notices. These cannot be opted out of.
  
  

• Parents may opt out of marketing communications, including newsletters and promotional updates.
  
  

• Notifications will primarily be delivered via email.
  
  
  

9. Dispute Resolution

• All disputes shall be resolved exclusively by binding arbitration, not by court litigation.
  
  

• This Agreement is governed by the laws of the United States and applies nationwide, including participants located in Canada.
  
  

• By enrolling, Parents waive the right to pursue class action lawsuits or jury trials.
  
  
  

10. Termination and Survival

• Accounts persist indefinitely unless deleted at Parent request.
  
  

• Inspirography LLC reserves the right to suspend or terminate participation if a Parent or Student violates these Terms or engages in harmful conduct.
  
  

• Sections concerning Waivers, Content Rights, Data Retention, Arbitration, and Disclaimers survive termination.
  
  
  

11. Parent Acknowledgment

• Parents agree to supervise their child’s participation, uphold all obligations, and assume responsibility for risks described herein.
  
  
  

• Parents agree to sign and acknowledge this Agreement electronically or in writing for each program session registration.
